Checking or drawing up a data processing agreement

Your customer and you both have a responsibility to ensure that you enter into the data processing agreement with each other. As an extra service to your customers, you might consider always having a standard processing agreement ready for them to sign.

A data processing agreement sets out the agreements on matters such as
What personal data you will be processing
How and for what purposes you will process the personal data
To which parties you may provide the personal data, and that those parties are subject to the same obligations as the processor
What security measures you have taken (or will take) to protect the stored data
How the rights of data subjects, e.g. right to access and to rectification, are safeguarded
